MINUTES OF MEETING FOR MONTGOMERY TOWNSHIP BOARD OF SUPERVISORS
Monday, October 27, 2008

Chairman Jeff McDonnell called to order the executive session at 7:00 p.m. In attendance were Supervisors Birch, Prousi and Sarosky. Supervisor Fox was absent. Also in attendance were Bob Gallagher, Matt Holliday, John Nagel, Larry Gregan and Frank Bartle. Items of potential acquisition of real estate by the Township were discussed.

Chairman Jeff McDonnell called to order the action meeting at 8:05 p.m. In attendance were Supervisors Birch, Prousi and Sarosky. Supervisor Fox was absent. Also in attendance were Frank Bartle, Larry Gregan, Bruce Shoupe, Rich Brady, Bill Brightcliffe, Pam Gural-Bear, Kevin Costello and Deb Rivas.

Under public comment, Nora O'Malley of 181 Pine Crest Lane stated that the consent agenda is not detailed enough to be informative to the public. Mrs. O'Malley said that she has attended several meetings lately and that the information listed on the consent agenda is not specific enough for the general public to understand what is being approved. Specifically for this evening, Mrs. O'Malley said that it was not clear what the grant application for a VFC Grant was or how much the bid award was for the vehicle lift, or which areas of the 202 parkway project were being offered for purchase and at what price. There was no other public comment.

Solicitor Frank Bartle announced that the Board had met in an executive session prior to this meeting to discuss matters of potential acquisition of real estate by the Township.

Chairman McDonnell opened the public hearing at 8:10 p.m. for the proposed liquor license transfer for Salsa's Montgomeryville, Inc. Notes of testimony were taken by court reporter, Tim Kurek. Paul Herron, representing the applicant, made a brief statement introducing Salsa's restaurant to the Township. Mr. Herron indicated that Salsa's restaurant would occupy the space vacated by Ruby Tuesday at the Montgomery Mall. Salsa's is a family style restaurant which serves Mexican dishes and will seat approximately 160 plus patrons. Mr. Herron reviewed the liquor license application and noted the restaurant's proximity to churches, schools and day care centers. There was no discussion from the Board, staff or public. The public hearing closed at 8:16 p.m. Resolution #1 unanimously approved the transfer of a liquor license for Salsa's Montgomeryville, Inc.

Stacy Crandell, Public Information Coordinator, presented the fifth annual Citizens University participants with diplomas for completion of the seven week program. Resolution #2 unanimously recognized and commended Lynn Caldwell, Robert Cassel, Jon Doscher, Michael Morales, Ralph Schurr, Susmita Singh and Mary Trocino.

Under the consent agenda, the minutes of the meeting for October 14, 2008 and the payment of bills were approved as submitted. Resolution #3 approved the FDMT grant application for a $5,000 purchase of a rescue strut system. Resolution #4 approved the award of the bid for a Heavy Duty Vehicle Lift to the lowest bidder, S.A.R. Automotive Equipment with a bid of $15,835.05. Resolution #5 approved the Penn DOT offer to purchase right-of-way for the Route 202 Parkway project in the amount of $94,700. Resolution #6 approved the escrow release for WB Commons in the amount of $131,112.52. Resolution #7 authorized the Township Solicitor to advertise for a public hearing for the Montgomery Township Comprehensive Plan Update 2008. All consent agenda resolutions were unanimously approved.

Under other business, Chief Richard Brady asked the Board to approve the application for the annual Seatbelt Highway Safety Grant in the amount of $5,500. Chairman McDonnell made a motion to approve the application and Supervisor Birch seconded the motion. The motion passed unanimously.

There being no further business, the meeting adjourned at 8:25 p.m.
