MONTGOMERY TOWNSHIP BOARD OF SUPERVISORS

JUNE 24, 2013

Chairman Joseph Walsh called the action meeting to order at 8:00 p.m.   In attendance were Supervisors Robert Birch, Candyce Fluehr Chimera, Michael Fox and Jeffrey McDonnell.  Also in attendance were Frank Bartle, Esquire, Lawrence Gregan, Chief J. Scott Bendig, Richard Lesniak, Kevin Costello, Bruce Shoupe, Shannon Drosnock, Ann Shade, Richard Grier and Deb Rivas.

            Following the Pledge of Allegiance, Chairman Joseph Walsh called for public comment from the audience and there was none. 

             Chairman Joseph Walsh made a motion to approve the minutes of the June 10, 2013 Board meeting, and Supervisor Michael Fox seconded the motion.  The minutes of the meeting were unanimously approved as submitted.

            Chairman Joseph Walsh noted that Montgomery Township is filled with many talented residents and the Board would like to honor students of Montgomery Township for their outstanding academic and athletic achievements.  Jacqueline James is a graduating senior from Mount St. Joseph's Academy where she rowed on the Mount's "Two-Vee" boat which won the gold medal at the 2013 Stotesbury Cup Regatta.  Ms. James was also named a National Merit Finalist and will be attending Villanova University on a Presidential Scholarship where she will continue her education pursuits in addition to pursuing her interest in rowing on the crew team. 

            Katie Mirabella is a graduating senior from Mount St. Joseph Academy, where she also rowed on the Mount's lightweight eight which won a three-way battle for second place at the 2013 Stotesbury Cup Regatta.  Ms. Mirabella was named a National Merit Finalist and is an AP Scholar.  She will be attending Princeton University where she will continue her educational pursuits in addition to pursuing her interest in rowing on the crew team. 

 

Mr. Walsh noted that many Township resident students participate in the Odyssey of the Mind international program which challenges teams of five to seven students to use their creativity and problem-solving skills to solve short-term "spontaneous" problems and a long-term problem that ranges from building mechanical devices to presenting their own interpretation of literary classics.  Mary Mother of the Redeemer School had three teams which succeeded in earning significant placements in regional, state and finals levels.  The students from the Mary Mother of the Redeemer teams introduced themselves and described their team's challenge.  The students from Mary Mother of the Redeemer who participated in the Odyssey of the Mind challenge were Julia Capreri, Julia Coakley, Connor Donohue, Nolan Dougherty, Nathaniel Ensanian, Mairin Higgins, Jessica Howard, Rachel Kalkbrenner, Molly Keel, Christopher Kelm, Jacob Lambert, Alexandra Lyons, Michael O'Donnell, Nicholas Orlando, Jack Pilewski, Hannah Soisson, Reanne Bull, Joseph Howard and Matthew Becker.

Pennbrook Middle School's Odyssey of the Mind team competed at the state level and placed fifth in their category.  The students from the Pennbrook Team introduced themselves.  The Pennbrook students who participated were Amy Cook, Molly DiPlacido, Anastasia Dziekan, Shannon Guerin, Andrew Jia, Cynthia Martinez and Brenna Ryabin.

The students and teams were presented with Certificates of Achievement from the Board of Supervisors and congratulated for their outstanding academic and athletic achievements.

            Connor Donohue, a fourth grade student from Mary Mother of the Redeemer, was recognized for his outstanding achievements in the Continental Math League.  Also, Alexandra Lombardi, a sixth grade student from Mary Mother of the Redeemer, was recognized for her Youth Essay of Merit Award for her Patriot's Pen submission, "What Would You Say to the Founding Fathers Today?"  The contest was sponsored by the VFW Post 6493.

            Police Chief Scott Bendig announced that Police Sergeant Thomas J. Dunlap would be retiring from the Montgomery Township Police Department after 40 years of service to the community.  Sgt. Dunlap began his career with the Montgomery Township Police Department as a Police Cadet on December 1, 1973.  Sgt. Dunlap was elevated to Full Patrolman in 1977, promoted to Corporal in 1984, becoming a founding member of the Township's first Traffic Safety Unit, and promoted to Sergeant in 1987.  Sgt. Dunlap has since then served as a squad supervisor, planning, organizing and directing the activities of officers assigned to his platoon.  Sgt. Dunlap has received numerous commendations and letters of appreciation from residents and neighboring agencies.  A representative from Pennsylvania State Representative Todd Stephens office presented proclamations from the Pennsylvania House of Representatives congratulating and commending Sgt. Dunlap on his retirement and thanking him for his service to the community.  Resolution #1, made by Supervisor Michael Fox, seconded by Supervisor Robert Birch and adopted unanimously, recognized Sergeant Thomas Dunlap and expressed their gratitude to him for his dedication and faithful service to the Montgomery Township Police Department and the residents of our community.

            Director of Public Works Director Kevin Costello introduced Public Works employee, Greg Reiff who is being promoted to the position of Park Foreman, effective June 24, 2013.  Mr. Reiff began his career with Montgomery Township in May of 2000 as a Laborer and quickly worked his way up to Crew Tech II.  In April of 2011, Mr. Reiff was promoted to the position of Assistant Park Foreman.  The Board thanked Mr. Reiff for his dedication and congratulated him on his promotion.  Resolution #2, made by Chairman Joseph Walsh, seconded by Supervisor Michael Fox and adopted unanimously, recognized the promotion of Greg Reiff to the position of Park Foreman in the Public Works Department.

            Director of Public Works Kevin Costello reported that the Public Works Department is requesting the Board's authorization to sell its 2001 Ford F-550 4x4 Bucket Truck and 2004 Kubota 72" ZD 28 Zero Turn Mower by online auction at Municibid.  The Township has successfully used the Municibid online auction company in the past year to dispose of surplus equipment.  Resolution #3, made by Supervisor Robert Birch, seconded by Chairman Joseph Walsh and adopted unanimously, authorized the sale of the Township's 2001 Ford F-550 Bucket Truck and a 2004 Kubota 72" ZTR Mower via online auction, through Municibid.

            Director of Fire Services Rick Lesniak reported that Ladder 18 recently experienced significant damage as a result of the drive shaft from the generator failing and striking the housing of the transmission causing two cracks in the transmission housing.  Five companies were contacted for estimates to make the necessary repairs.  The estimates ranged from $9,431.24 to $16,123.44 to replace the damaged transmission with a re-built transmission.  New transmission units are not available.  Mr. Lesniak recommended that the Board consider the replacement of the transmission as the ladder is expected to serve Montgomery Township for at least the next ten years.  Mr. Lesniak reported that staff is recommending the repair be approved for Del-Val International Trucks, Inc. of Montgomeryville to replace the transmission at a cost of $9,431.24.  Resolution #4, made by Supervisor Robert Birch, seconded by Supervisor Candyce Chimera and adopted unanimously, authorized Del-Val International Trucks, Inc. to replace the transmission at a cost of $9,431.24.

            Police Chief Scott Bendig reported that the Police Department had received a grant in 2009 to purchase twelve (12) in-car audio/video recording systems for the police vehicles.  It was recently discovered that service/maintenance agreements were never purchased when these systems were installed in 2011.  The cost to purchase the service/maintenance agreements is $3,420.00.  As these cameras have been instrumental in presenting airtight cases against a suspect, while also protecting the Department from frivolous lawsuits, it is recommended that the service/maintenance agreements be purchased.  Resolution #5, made by Supervisor Michael Fox, seconded by Supervisor Robert Birch and adopted unanimously, approved the expenditure of $3,420.00 for the purchase of service/maintenance agreements for the twelve in-car camera systems from CDW-G, under the COSTARS Cooperative Purchasing Program Contract 003-032.

            Director of Planning Bruce Shoupe reported that an application for a change of zoning had been received from Terra Vista, LLC, proposing an extension of the Billboard Overlay District on portions of four properties which are located south of Stump Road along southbound Bethlehem Pike.  The request is that the Billboard Overlay District be allowed on the southbound side of Bethlehem Pike starting approximately 420 feet south of the centerline of Stump Road for a distance of 990 feet with a depth of 150 feet from the centerline of Bethlehem Pike.  Resolution #6, made by Supervisor Michael Fox, seconded by Supervisor Robert Birch and adopted unanimously, set Monday, August 26, 2013, after 8:00 p.m. in the Township building as the date, time and place for a Public Hearing to amend the Zoning Map by extending the Billboard Limited Industrial Overlay District.

            Township Manager Lawrence Gregan reported that in 2010, the Montgomery County and Bucks County Planning Commissions had prepared an Act 167 Stormwater Management Plan for the Neshaminy Creek Watershed and had requested municipalities to endorse the adoption of the plan.  At that time, Montgomery Township raised an objection to the plan due to the significant financial burden that the plan would impose on Township single family property owners when they tried to construct improvement and/or additions to their homes and properties.  As an alternative, the Township recommended that the plan include a "fee-in-lieu-of" (FILO) provision for single family property projects disturbing greater than 1,000 square feet but less than 5,000 square feet.  Following several years of negotiations with the two County Planning Commissions and the Pennsylvania Department of Environmental Protection, the Township's persistence has paid off with the inclusion of the Township's recommended "fee-in-lieu-of" (FILO) alternative into the plan.  The new language and plan has been reviewed by the Township Engineer and is now recommended for approval.  Resolution #7, made by Supervisor Michael Fox, seconded by Chairman Joseph Walsh and adopted unanimously, endorsed the adoption of the Neshaminy Creek Watershed Act 167 Stormwater Plan as amended with the inclusion of the "Fee-In-Lieu-Of" (FILO) Alternative for Small Projects.

Township Manager Lawrence Gregan reported that in September 2012, the Cutler Group authorized Wolverine Constructors to proceed with certain improvements on Friendship Park.  This work involves site grading and paving improvements on the property.  The total cost for this scope of improvement to the park is $513,681.37 and Wolverine Constructors is seeking the ninth and tenth progress payments from the Cutler Group in the amount of $140,929.50 bringing the total amount paid for the work completed to date to $411,709.35.  The Township Engineer has inspected the site and found the work completed to date to be satisfactory and in accordance with the approved plans.  Resolution #8, made by Supervisor Michael Fox, seconded by Supervisor Robert Birch and adopted unanimously, accepted the Engineer's recommendation that the site work being performed at Friendship Park by Wolverine Constructors, has been completed in accordance with the approved plans and specifications and that the Cutler Group be notified of the Township's acceptance so they can proceed with payment to Wolverine in accordance with the provisions of their contract.

            Supervisor Michael Fox made a motion to approve the payment of bills.  Supervisor Robert Birch seconded the motion.  The payment of bills was unanimously approved as submitted.

            There being no further business to come before the Board, the meeting adjourned at 9:00 p.m.
