Dear Taxpayer:
This letter is written to address your concerns by clarifying the differences between the Business Privilege/Mercantile Tax and the Earned Income/Net Profits Tax. We appreciate your thoughts and concerns. We offer the following response:
Local municipalities are provided a variety of options for tax reform by the Commonwealth of Pennsylvania. The Montgomery Township Board of Supervisors has studied and analyzed all of its options to assure the most equitable mix of taxes between taxes paid and services received by both our residents and businesses. The primary sources of tax revenues levied by Montgomery Township are Real Estate, Business Privilege/Mercantile, Earned Income/Net Profits, Occupational Privilege and Amusement. All of the taxes Montgomery Township levies are separate and distinct of each other thereby eliminating any possibility of double taxation.
The Pennsylvania Courts have ruled that double taxation exists only where there is the imposition of the same tax by the same taxing power upon the same subject matter. The tax base upon which the Business Privilege Tax is imposed is different from the tax base upon which the Earned Income Tax is imposed. The Business Privilege Tax places a millage tax ($1.50 for every $1,000 in gross receipts) on Gross receipts; the Earned Income Tax places a flat percentage rate on either "earned income" or "net profits". As to an individual business, the Earned Income Tax (1%) is based on net profits. Since "net profit" is defined as the net income from the operation of a business after provision for all costs and expenses, it is readily apparent that gross receipts and net profits reach different tax bases.
As an example, a taxpayer may have zero net profits and therefore pay no Earned Income Tax while at the same time have gross receipts which would require him/her to pay the Business Privilege Tax; thus, the subject matter of the two taxes differ. Furthermore, the Business Privilege Tax is applicable only to those persons engaged in business while the Earned Income Tax must be paid by all individuals having an "earned income" or "net profit".
We hope this information addressed your questions and concerns. We also invite you to an upcoming Finance Committee meeting, if you have any further questions or concerns.
Sincerely,
Montgomery Township Board of Supervisors

Montgomery Township does not have its own municipal trash collection service. Trash haulers, however, are licensed by the County to insure that they follow proper disposal practices. Residents have the option to choose a trash hauler of their preference. It is recommended that you check with your neighbors to determine which trash haulers collect in your neighborhood. Prices may vary from hauler to hauler depending on the number of scheduled pick-ups per week. The Township waste ordinance requires that all trash be placed in approved containers and not put out more than 24 hours in advance of collection.
In addition to regular trash collection, these haulers are required to collect mandated recyclable items - aluminum, clear glass and newspapers (plus high grade office paper and corrugated cardboard from businesses). When arranging your private trash collection, please get instructions on how to prepare your recyclables and which day the hauler collects recyclable items.
